A misdemeanor charge in Ohio can have serious, lasting effects. The most obvious is the potential to serve jail time; the less obvious can include termination by your employer, driver's license complications, financial expense, inability to obtain new employment, issues with licensed vocations, problems in child custody conflicts, among others. Adult misdemeanor maximum penalties:

  • 1st degree: 180 days in jail, $1000 fine plus court costs
  • 2nd degree: 90 days in jail, $750 fine plus court costs
  • 3rd degree: 60 days in jail, $500 fine plus court costs
  • 4th degree: 30 days in jail, $250 fine plus court costs
  • Minor Misdemeanor: $150 fine plus court costs 

Additional considerations:

  • Drug offenses carry a discretionary license suspension even if a vehicle was not relevant to the charge
  • OVI, DUS, and some other offenses carry mandatory minimums; meaning, the Judge MUST sentence the offender to a jail term, a license suspension, or a minimum fine amount 
  • Judges can order you to attend various treatment programs, classes, restitution to the victim, or other less typical punishments such as writing an apology letter
