POSSESSING, USING, OR LENDING A "FAKE ID"

THE LAW

You cannot possess, use, or display a fake, altered, suspended, or cancelled ID or driver's license. You cannot use someone else's ID or driver's license. You cannot lend anyone your ID or driver's license. Specifically, Ohio Revised Code 4507.30 states:

"No person shall do any of the following: 

(A) Display, or cause or permit to be displayed, or possess any identification card, driver's or commercial driver's license, temporary instruction permit, or commercial driver's license temporary instruction permit knowing the same to be fictitious, or to have been canceled, suspended, or altered; 

(B) Lend to a person not entitled thereto, or knowingly permit a person not entitled thereto to use any identification card, driver's or commercial driver's license, temporary instruction permit, or commercial driver's license temporary instruction permit issued to the person so lending or permitting the use thereof; 

(C) Display, or represent as one's own, any identification card, driver's or commercial driver's license, temporary instruction permit, or commercial driver's license temporary instruction permit not issued to the person so displaying the same"

THE PUNISHMENT

 Any violation of the above is a first degree misdemeanor (the most serious misdemeanor). It is punishable up to a maximum of 180 days in jail and a $1000 fine, plus court costs. Additionally, if you are a minor and arrested for underage possession or purchase and you brandished or used a fake ID, you will not be permitted to enter into the underage drinking diversion program in Franklin County. Additionally, you could risk getting the person who loaned or gave you the ID in trouble, as well. 

TIPS TO AVOID CONVICTION

  • Do not use a fake ID; 
  • Do not lend anyone your ID;
  • If you are stopped by law enforcement, do not provide the fake ID; 
  • If you have a fake ID, do not keep it in the same wallet or place as your real ID; and
  • Call your lawyer immediately!
